Posted 4 months ago Wow, You've kinda hi-jacked every thread. I see by your profile that you're considering nursing. How this misdemeaner comes in to play is going to depend on several things. 1. Were you a minor at the time? 2. Was this an assault or a drug issue? If it was a drug issue, was it simple possession of a joint, or something harder? If you were a minor, and it was expunged it's pretty much history. If it was something like you were 18 and got busted with a joint, and have been a good boy since, most employers aren't going to hold that against you. I would talk to an attorney, it it's anything too complex, because you would need clarification on what to check on the employment application it it's been 'expunged'. Because technically, it didn't exist, and you would be in a grey area.

Posted 4 months ago However, some applications ask if you have ever had an arrest that led to an expungement or deferred charges. Additionally, if the charges were for drug use, or assault there are often employment questions that specfically address that. Depending on the charges, his fingerprints could be on file...they ARE NOT removed when your record is expunged, and if your in a field or state that requires fingerprinting, he may have some explaining to do (especially if the charges stemmed from drug or assault charges and that he answered no on his application to same). And not that this is the case, but certain government jobs, and all military fields require full disclosure on even expunged, juvenile, and deferred charges.

Posted 4 months ago http://en.wikipedia.org/wiki/Expungement this explains it better, In some states, your record can still be legally accessed by law enforcement. Consult a lawyer, if your case is complex, because this varies by state.

Posted 4 months ago Thanks kittryn for your feedback. I was almost 19 when I got charged with misdemenor. It was for theft when I worked at a retail store, its wasn't any assault or any kind of drugs involved. Im 25 now and haven't had any trouble with the law since.
